Thankfully, the final<br \/>\njudgement from the above case found in the landlord&#8217;s favour, which<br \/>\nshould help to clarify that advance rental payments cannot (in most<br \/>\ncases) be treated as a deposit.<\/p>\n<p>Why accept advance rent payments?<\/p>\n<p>Asking for several months rent to be paid in advance is wise for any<br \/>\nnumber of reasons. Most of the time landlords do this because a<br \/>\ntenant has failed their credit check or is a bad risk for some other<br \/>\nreason. By insisting on at least 6 months rent in advance, the<br \/>\nlandlord can hopefully avoid being left out of pocket if the tenant<br \/>\ndefaults on their payments.<\/p>\n<p>The difference between <a href=\"http:\/\/www.propertyportfoliosoftware.co.uk\/features_and_demos.html#31\">advance rent and a deposit<\/a><\/p>\n<p>The issue of whether rent paid in advance can be classed a deposit is<br \/>\nan important one. As all landlords know, deposits must be placed in a<br \/>\ndeposit protection scheme whereas rent payments are placed into a<br \/>\nrent account as opposed to being held as security. This was one of<br \/>\nthe grounds for appeal in the case of Johnson vs. Old: the tenant<br \/>\nclaimed the landlord had not protected the sum of money paid in<br \/>\nadvance by placing it in a secure deposit scheme.<\/p>\n<p>How can issues like this be avoided?<\/p>\n<p>Drafting a clear and transparent tenancy agreement is the best way to<br \/>\navoid potential problems regarding financial issues.
